mallicoat. it is 5:01 on this tuesday. well, it's back to work day in washington, d.c., where the house is preparing to vote on raising the nation's debt limit, a move the president has pushing for. susan mcginnis tells us how the deal was reached. >> reporter: they had their dance. and taken a moment to savor the scene. now it's time to get back to work. in his inaugural speech, the president called on both parties, not to let politics get in the way of governing. >> we must act, knowing that our work will be unperfect, we must act knowing today's victories will be only partial. >> reporter: republicans are offering a compromise on the debt ceiling, house g.o.p. members are backing off a requirement to cut $1 of spending for every dollar the debt ceiling is raised, a move the president has demanded. >> it's believe it's a recognition of political

reality. we realize the president won the election. >> republicans on capitol hill are not voting to raise the debt ceiling without getting something in return. they say in order to approve a higher debt limit, they want senate democrats to do something they have not done in four years, pass a budget. >> for us to have a debate about spending and debt we've got to have the focus be on a budget and what we're going to do to achieve a balanced budget over time. >> senate democrats view a vote as an opportunity to raise more money through taxes. >> it's going to be a great opportunity for us, because in our budget that we will pass, we will have tax reform which many of my republicans like but it will include revenue. >> the increase will likely happen tomorrow. one other provision of the debt limit vote is either chamber of congress fails to pass it, the members will not get paid till they either pass a budget or until the 113th congress expires at the end of 2014. the big question for

football fans around here is, are you going to the super bowl? >> for most, the answer to that question is no. cbs 5 reporter cate cauguiran has details. >> reporter: season ticket holders were entered into a raffle as to how many tickets have available in that raffle, the niners have not said but those winners will be announced today. as for those niners fans that are not season ticket holders, the super bowl high could come down the moment you see the prices. fans right now are flocking to the web, to give you an idea, stub hub has them starting a little over $2000. at the 49'ers team store in palo alto fans told us the seats they are investing in are the ones in their living rooms. >> are you going to the super bowl? >> unfortunately i'm not. >> are you going? >> no. >> yeah, i wish. >> are you going to give me

seminary and bromley avenues. one suspect was arrested, the officer is expected to recover. a heated debate is expected at the meeting of the oakland city council, the big issue, whether to pay a quarter million dollars to hire an anticrime consultant, william bratton, who let police departments in new york, boston and los angeles. he has strong supporters and critics. baton has a history -- bratton has a history of helping crime but there is concern about his stop and frisk and zero tolerance. let's find out what's cooking on this tuesday. >> we've got a storm brewing. we haven't said that for three weeks, it looks like, yeah, we've got clouds beginning to make their way across the skies. no rain today, it will be a fairly pleasant day outside. hazy sunshine. you can see the storm clouds off the coastline but that is going to start to move onshore, as we head toward tomorrow. we're going to see rain making a welcome return to the bay

the bend, no brake lights between 880. typically, around 6:45 this is when we see a few delays across that stretch. right now you can beat the rush, great toward sunnyvale. westbound 84, dumbarton bridge, work scheduled to wrap up at 5:00. caltrans says it's still in lanes, a heads up if you're crossing the dumbarton. road work up and down the 101, peninsula, southbound between oyster point and grand avenue until 6:00. between 92 and kehoe, that's scheduled to wrap up at 6:00. it's still early, traffic is light. you can see a drive time sensor picking up speeds, about 64 miles per hour. coming up we'll get a check of mass transit. back to you. >> elizabeth, thank you. today work gets underway to fix damaged fenders at the base of the bay bridge tower after a tanker hit it earlier in the

month. the work will cost several million dollars. elissa harrington has more on what's ahead. good morning. >> reporter: good morning, michelle. the repairs will cost about $3 million. caltrans will begin the work today. there's money in reserves but the metropolitan transportation commission also wants the ship's owner to help pay. that's osg ship management. it's been two weeks since an oil tanker struck the bridge the morning of january 7th. the 752-the new vessel hit the eastern most tower on the westernmost span. the fender system was damaged, caltrans will replace the damaged sections, no oil was spilled, an investigation is ongoing and the fixes should be completed in may. live in the newsroom, elissa harrington, cbs 5. >> thank you. unusually strong winds create dangerous surfing conditions. one san francisco surfer learned that the hard way last

night. chopper 5 over the cliff house in ocean beach where he was stranded with only a surfboard. linda shows us his daring jump to safety. >> reporter: daniel rosen calmed down after scrambling up seal rock. >> a big rip tide, really big waves. way out of my element. >> reporter: he was surfing with a buddy but admits he's an amateur and couldn't handle the rip current. >> started getting sucked out to the bay, climbed on the rock because i didn't want to go out to get eaten by a shark. >> it's frightening, that moment you realize there's something stronger than you pulling you out, it's no good. >> reporter: his friend made it to shore and called for help but even rescue crews could in the get close enough so the surfer had to jump back into the water and paddle towards them. rosen was hesitant, but he did it. >> i was paddling out into the

dublin interchange. let's go to a map, we're watching different incidents. just got word from chp, they cleared this, a downed tree reported northbound 880 at first street, on the on-ramp. that is no longer an issue. now we're getting word of this problem, this is a stalled out bus, passengers are on board. it's northbound 101 approaching the 280 interchange. it sounds like it's possibly blocking a lane. you may find slowing there. they did pick up the overnight road work on the dumbarton bridge, westbound 84, after 5:00 this morning. and more road work, this time along the peninsula southbound 101 between oyster point and grand. northbound 101 out of san mateo between highway 92 and kehoe. mass transit still reporting no delay. that's a check of our timesaver traffic. >> i'm still shocked into the

easternmost tower on the western span. the 752-foot vessel did not leak oil and nobody was hurt. now the metropolitan transportation commission wants ost ship management, the owner of the ship, to help pay for repairs. there's also money in reserves. investigators are looking into what caused the collision. repairs are beginning today, and will be completed in may. elissa harrington, cbs 5. developing news in oakland, one man in custody, police are looking for two other suspects, after a shooting that wounded an undercover police detective in the arm. we are joined via telephone from oakland with an update on the manhunt. holly, what can you tell us? >> we're at seminary and east 17th, the western edge of the perimeter set up since 6:00. the officer who was looking into a series of shootings was shot in the arm, one person in custody, one gun recovered, two

others they are looking for, police are focusing on this apartment on seminary. the s.w.a.t. truck is parked out front. the perimeter remains up, keeping some people out of their homes for the last 12 hours. this comes before the oakland city council, the full oakland city council, tonight is set to consider a quarter million dollar contract awarded to expert william bratton to reduce crime. frank and michelle? >> how about the detective? >> he's expected to recover. he was out here investigating a number of shootings, you may recall there was a shooting out here on sunday, and that's a week after five people were shot in front of a birthday party about a week before that. there have been a number of activities here, and they are trying to figure out what's going on, they were pursuing that. it's not clear whether the people that this officer was talking to may have been

suspects, may have been associated with any of those shootings, we're not sure. we're hoping to get details from a spokesperson in the next couple hours. >> holly quan, thank you for that report. the oakland city council will consider tonight whether to pay a quarter million dollars to hire the anticrime consultant, a big name, william bratton, previously leading the police departments in new york, l.a. and boston, with plenty of support and critics. he has a history of helping reduce crime but some are concerned about the zero tolerance and stop and frisk tactics. the police chief wants to start a pilot program to allow 100 officers to carry tasers, the officers would have special training to deal with mentally ill people. the meeting tonight starts at 6:00. it will be at the hamilton recreation center at 1900 geary boulevard, two more community

check out the roads with elizabeth. >> a few minor problems including a stall on the incline section of the upper deck of the bay bridge. fortunately it's still early, and they have not turned the metering lights on. the accident or the stall, rather, is on westbound 80 right there approaching the incline. we can go to our maps and show you what it looks like. a tight squeeze towards treasure island, sounds like the stall is at the top of the ramp where they are working to clear it. bridge crews are aware of it. past treasure island, by the way, we're seeing top speeds once again. a report of an accident, this one on 238 approaching 880, we're not sure about lanes blocked, chp is headed to the scene. we see a couple accidents in the area, in the last couple days, so be extra careful if you're traveling through that stretch. otherwise, milpitas, 880 and 237, no delays all the way out

onto train tracks... she is rescued just as a subway train is a woman in spain faints and falls on the train tracks below. she's rescued as the subway train is approaching. this happened yesterday in madrid. an off-duty police officer heard the sound of the woman falling, acted immediately, and at the same time people on the platform waved to tell the train operator to stop the train. the woman's condition is unknown but they did get her off the tracks. >> good thing. >> wow! earnings reports come out this week with google scheduled to report today. the internet giant will double its investment in berkeley county, south carolina. the company will invest $600 million in its operations, and

hire more workers. google opened its first data center in berkeley county, five years ago. apple reports earnings tomorrow, some predict the maker of the ipad and iphone may report its first decline in profits in nine years. apple stock fell earlier this month on reports that demand fore its iphone 5 may be waning. brian cooley will have more on what apple needs to prove in the coming year at 6:45 this morning. the biggest reason families don't receive college financial aid may surprise you. >> millions never bother to file because they don't think they are going to qualify. jill schlessinger from cbs money watch is here to address a common financial aid myth and how much savings hurt. >> reporter: retirement money is not counted against you on the free application for federal student aid form, fafsa. it doesn't even ask families if

they have a retirement account. additionally, everyone can shield some cash from federal financial aid calculations, the amount is tied to the age of the oldest parents, older parents get a break because they are near retirement. >> how is the exemption determined? >> reporter: there's an education asset protection work sheet that details the amount. let's say the older parent is 50 years old. the couple can shield $40,900, including education fund assets like 529 plans. if parents have more than that, the surplus is assessed at a rate of 5.64%. so, again, if our parents saved $60,000 for college, their expected contribution for a year of college is about $1100.

to come. temperatures in the 50s and 60s. next couple days, things stay unsettled. thursday and friday partly cloudy, this weekend a chance of a few more cold showers headed our way. >> thank you, lawrence. we have problems now over at the bay bridge. i mentioned that stall on the incline section. i don't know if it was involved in that stall but now there's report of an accident in the same area. so we're not sure if a car tried to swerve to avoid the stall. now chp is responding to that. we've got two issues on the upper deck, they did turn on the metering lights a few minutes ago. this is early to see the metering lights, and the delays are growing. they turned them on four minutes ago, it's stacking up towards the middle of the parking lot. again, this could be a big bay bridge wait for the next hour or so. it takes a while for this to clear. elsewhere, let's go out live towards the south bay, a live look at the 101 near the trimble exit, northbound and southbound moving at the limit.

no major delays across the area. elsewhere live toward 880 in oakland, near the oakland coliseum, and 66th. everything is moving fine, between heyward and downtown oakland. they did pick up overnight road work, in lanes between fruitvale and 66th. this accident is still there. we don't have a lot of details but northbound 238 approaching 880, an accident possibly blocking lanes. that's a check of traffic, back to you. nonstop flights between san jose and tokyo are on hold through monday, al nippon is following a federal order to ground 787 dream liners to assess fire related risk. they are unable to use larger planes at mineta international airports with shorter runways surrounded by the cities of san jose and santa clara.
